Terms & ticket conditions
General terms and ticket conditions for Ungeniert: registration, waiting list, guest list, no box office, refunds, dress code, exclusion, house rules.
1. Scope
These general terms and conditions govern the legal relationship between Tassadar GmbH, Tellgasse 25/1, 1150 Vienna, Austria (hereinafter “we” or “the organiser”), and participants (hereinafter “you”) in connection with the event series “Ungeniert”, the website ungeniert.org and the registration and ticket system at event.ungeniert.org.
Participation in Ungeniert events takes place exclusively on the basis of these terms and, subordinately, the applicable Austrian law.
PRÜFEN: Does Tassadar GmbH act as the organiser of Ungeniert itself (unlike third-party events on libelle.at, where it only acts as intermediary)? Assumed here.
2. Registration
Participation in Ungeniert requires a one-time registration at event.ungeniert.org, including a questionnaire. We review your details and decide at our own discretion whether to approve you for ticket purchase. There is no entitlement to approval; we do not owe a reason for a rejection.
The minimum age for participation is 21. By registering you confirm that your details – in particular name and date of birth – are correct. False details entitle us to exclude you without refund.
Buying a ticket is only possible after approval. Anyone already approved can buy tickets for further events directly, as long as the approval remains in place.
3. Tickets, waiting list and guest list
Tickets are available exclusively in advance through the registration system. There is no box office.
With the binding purchase and payment you declare that you have read and accepted all information about the respective event (content, schedule, dress code, door policy, consent rules). If you have questions or doubts, it is up to you to inform yourself fully in advance by email to info@libelle.at.
After purchase you are placed on the waiting list for the respective event. We compile the guest list from the waiting list, paying attention to a balanced mix of guests. There is no entitlement to a guest-list spot. Only the ticket email confirming your guest-list spot entitles you to attend.
If you do not get a guest-list spot, we refund the full ticket price to the original payment method. PRÜFEN: timing of the refund – automatically after the guest list closes? Within what period?
The ticket price is stated on the respective event page and in the registration system. The price displayed at the time of purchase applies. Payment is processed via our payment service provider; by entering your payment details in its form, a contractual relationship arises between you and the payment service provider to which we are not a party.
4. Personal ticket
Your ticket is issued to you personally. The identity of the person booking is an integral part of the contract and cannot be changed unilaterally until the end of the event. We are entitled to verify your identity before the event begins. Refusing to cooperate in this identity check leads to exclusion from the event without any claim to a refund.
Passing on or reselling tickets is expressly excluded; any attempt leads to forfeiture of the ticket price paid.
5. Entry, dress code and door policy
Entry is possible during the times stated on the event page (usually from 21:00 until 00:00). Later entry is only possible by prior arrangement.
A dress code and a door policy, published on ungeniert.org, apply to all Ungeniert events. Our team at the door decides whether your outfit and condition comply with the dress code and door policy. If you are refused at the door for not complying with the dress code, for visible impairment by alcohol or other substances, or for other reasons under the door policy, there is no entitlement to a refund of the ticket price.
Street shoes are not permitted in the venue.
6. Rules of conduct and exclusion
The rules published under “Awareness & Consent” apply to all events, in particular:
- An absolute no-photo and no-phone rule applies. Mobile phones are taped over at the entrance.
- Any physical approach requires a prior, clear and enthusiastic “yes”. Anything else means “no”.
- Illegal drugs are prohibited; alcohol is to be consumed responsibly.
- Instructions from the team, in particular the awareness team, must be followed.
In the interest of the safety and wellbeing of all guests, we are entitled to remove individuals from the event if they do not comply with these rules or the venue’s house rules. If exclusion occurs after the start of the event due to such a violation, there is no entitlement to a refund. In the case of serious or repeated violations we may issue a ban and permanently withdraw approval.
If we exclude you between ticket purchase and the start of the event for reasons not related to your conduct, we refund the ticket price.
7. No-show and cancellation
If you do not attend the event – for whatever reason – there is no entitlement to a refund of the ticket price.
PRÜFEN: Does the libelle.at cancellation rule apply to Ungeniert (cancellation up to 48 hours before the event, refund minus payment and handling fees of EUR 5 within approx. 4–8 working days)? Or is a purchased ticket non-refundable once the ticket email has been sent? Please decide on one variant.
Right of withdrawal: Under section 18(1)(10) of the Austrian Distance and Off-Premises Transactions Act (FAGG), there is no statutory right of withdrawal for contracts for leisure services provided at a specific time (event tickets). PRÜFEN: have this confirmed legally.
8. Changes and cancellation of the event
During registration you provide an email address so we can inform you about changes. If you do not provide it or provide it incorrectly, we cannot reach you; we have no further obligation to track you down. We recommend checking the event page before the event for any changes.
The following applies:
- Minor changes to the programme (e.g. specials, lineup) do not entitle you to withdraw.
- A change of venue for organisational reasons does not entitle you to withdraw.
- If the event is postponed to another date, you may withdraw from the purchase and receive a refund of the ticket price.
- If the event has to be cancelled without replacement, we refund the full ticket price.
9. Liability
You take part in the event at your own responsibility. We are liable for damages only in cases of intent or gross negligence; this does not apply to personal injury. We accept no liability for items brought along, including in lockers, to the extent permitted by law. PRÜFEN: have the liability clause reviewed legally.
10. Data protection
Information on how we process your data can be found in our privacy policy. We treat your registration data strictly confidentially and do not pass it on to third parties.
11. Final provisions
Austrian law applies, excluding the conflict-of-law rules of private international law. For consumers this applies only insofar as it does not override mandatory provisions of the law of the state in which they have their habitual residence. The place of jurisdiction is Vienna, provided you have your residence or workplace in Vienna or no mandatory statutory jurisdiction applies.
Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
